Land Dispute: Ondo Court Rules In favour of Family against JOMAV Home

…Awards N7,000,000 Damages Against Estate Developer

The Ondo State High Court (Akure Judicial Division) delivered judgment in favour of Mr. Kayode Ekun and two others, against Jomav Home & Property Nigeria Limited over 5.5 acres of land within a larger expanse of land sold to the Company by Chief Olatubosun Miller (Olu of Olokuta Community), on 30th May, 2025.

In his judgment, Hon. Justice D.I Kolawole declared the Claimants Owners of the land and declared Jomav Home & Property Nigeria Limited a “trespasser” on the land.

The court further awarded Seven Million (N7,000,000) as General damages against the Company, directing that the said sum be paid to the Claimants.

Mr. Kayode Ekun, Mr. Boluwaji Ekun and Mr. Oluwayemi Ekun who sued for themselves and on behalf of Late Mr. Samuel Ekun’s family of Aponmu instituted Suit No. AK/201/2022 against Jomav on 30/05/2022 for the trespass committed by the Company on their land.

Barr. Jerry ‘Bukunmi Adeyogbe. Esq., Counsel to the Claimants who spoke to newsmen hailed the judgment as “epochal”.

He also advised that every subscribers and/or prospective subscribers to any land ownership scheme should conduct proper Due Diligence before investing in lands or buildings being developed by such Company.

Adeyogbe, however, warned that those who invest by subscribing to the lands within the Estate being constructed by the Company without conducting proper due diligence do so at their own peril.

Adekola Olawoye, SAN, Counsel to Defendant was, however, not in court on 30/05/2025 for comments, but Ayo Ayeni Esq. represented him.
